Founding Member Terms

These terms apply to a Founding Member purchase. They are written plainly on purpose. If anything here is unclear, email Operations@gunsmithapp.com before you pay.

Terms

1. What you are buying. A two-year subscription to the plan you select, paid in a single payment at the price shown at checkout. It is one charge, not a recurring one.
2. When your two years start. Your term begins on the day your payment clears. Your two-year period, your four-year rate protection and your 30-day refund window all run from that date.
3. Your rate is protected for four years. Your two-year term, plus one two-year renewal at the same price — four years at the price you paid — provided your subscription remains continuously active. We will not raise that price during that time, and this overrides any general right we hold elsewhere to change subscription fees on notice.
   
   What the protection covers: the subscription price of the plan and discipline you bought. It does not extend to any amount imposed on the transaction by anyone other than us. If you change plan or discipline, protection ends and the new plan is at the price current at that time. Protection is personal to your account: it is not transferable, and it does not pass with a sale or transfer of your business, listing or account. To use your renewal you must tell us before your two-year term ends; a renewal not taken by that date is not held open. If we no longer offer your plan at renewal, we will offer the nearest equivalent at the price current at that time. After the second term, renewal is at the price current at that time.
4. If your subscription ends early. If you cancel, or if we end your subscription under clause 9, rate protection ends immediately and cannot be restored, and the remainder of your term is not refunded except as clauses 7 and 11 provide. You are welcome back at whatever the current price is. Nothing else about your listing changes — your claimed shop, your verified badge and your reviews stay yours, so long as the license or credential behind them remains valid.
5. Renewal. Nothing renews itself: your payment is a single charge, and we hold no standing authority to bill you again. Before your two-year term ends we will contact you. You may then renew once at your protected rate, change plan, or stop.
6. The features you are paying for. You are buying the plan as it is described on the pricing page on the day you pay. If a feature described there is not available on your plan within twelve months of your term starting, and we have not replaced it with something that does the same job, tell us within 60 days of that date and we will credit your account a pro-rata share of the remainder of your term.
   
   This is your only remedy for a feature that does not arrive, and it does not apply where the cause is outside our control — including a change in law or regulation, an app store or platform policy, or a bank, payment processor or other supplier declining to serve this category.
7. Refunds. Within 30 days of your term starting, for any reason, in full. Refunding ends your subscription and your rate protection on the day we issue it, and returns your listing to the free plan. One refund per account, and a Founding purchase cannot be made again on an account that has taken one. This clause does not apply if we ended your subscription under clause 9, or if the payment is the subject of a chargeback or payment dispute. After 30 days, clauses 6 and 11 are the only refund or credit rights these terms give you.
8. What this document does and does not change. These terms govern the price, the length of your term, and the refund and credit rights described above. Where they differ from the general Terms of Service on those three subjects, these terms apply to your Founding Member purchase. On every other subject the Terms of Service continue to apply in full and are not modified here — including the disclaimer of warranties, the limitation of liability, indemnification, arbitration and the class-action waiver, and governing law and venue.
9. When we can end your subscription. We may end it if you breach the Terms of Service, use the platform unlawfully, obtained the purchase by fraud or misrepresentation, charge the payment back or dispute it, lose the license or credential your listing depends on, or behave in a way that puts other users or our staff at risk. Where the problem can be fixed, we will tell you and give you 30 days to fix it. Where it cannot, we may act immediately. We may suspend your listing while we look into any of the above. Ending your subscription under this clause does not entitle you to a refund of any part of your payment.
10. Features change. We add, change and retire features as the platform develops, and we decide what the product contains. Clause 6 is your remedy if something described in your plan goes away and is not replaced. Nothing in these terms requires us to keep any particular feature, design or integration unchanged.
11. If we stop offering the service. If we discontinue GunsmithApp™, or discontinue your plan without an equivalent replacement, we will tell you and, at our option, either move you to a comparable plan or refund the unused portion of your term pro-rata to the day service ends. That is your only remedy if this happens. It does not apply where we stop because we are required to by law, regulation or court order, or because an app store, bank, payment processor or other essential supplier declines to serve this category.
12. The version you accepted governs. Your purchase is governed by the version of this document in force on the day you paid, recorded with your subscription. We may change these terms for purchases made after that date; a later version does not reach back and change a purchase already made.
13. Your remedies under these terms. The refunds and credits described above are the complete set of remedies these terms give you, and our total liability under them will not exceed the amount you paid for your Founding Member purchase. This does not limit the separate limits in the Terms of Service, which continue to apply.
